RENTAL CONTRACT

This agreement is for hourly rental space at The Space, 23 Heather Crescent, London, ON, which is held and offered by Alexis Wild, operating More Joy, Better Life.

By completing this online from, you indicate that you are aware that this online contract is legally binding. After completion of this contract and payment, your rental time will be secured for you. NO booking is secured without contract and payment.

PAYMENT

Payment for rental space is to be made by EMT to bookthespacelondon@gmail.com. (Please do not email this address — it is for payments only.)

Rent is $55/hour plus HST. Daytime rentals are discounted. Bundle or multiple hours/month are discounted.

Payment for single events is due at the time of booking. No booking is confirmed until full payment has been received.

A refundable damage security deposit of $300 is required for your booking. This may be made at the time of booking or one week before your event. If this is not received, your booking may be cancelled. This deposit will be refunded within 2 business days after the booking time, provided The Space is returned in the same condition it was received and no damages, cleaning fees, or overtime charges are incurred. If damages or cleaning fees exceed $300, they will be immediately billed to the Renter, to be paid within seven days of receipt.

Booking times include a free 15 minute buffer before and after the rental time. Renter agrees to arrive within this time, and to vacate The Space promptly at the end of the scheduled rental period. Any time before or beyond the agreed-upon end time will be charged at a rate of $60/hour, billed in 15-minute increments, at the Owner’s discretion.

CANCELLATION & REFUND POLICY

All rental payments are non-refundable under any circumstances. Once a booking has been made and payment received, no refunds will be issued for cancellations, no-shows, or schedule changes initiated by the Renter.

The Renter may transfer their booking to one new date with a minimum of 14 days’ notice, provided the new date is within 60 days of the original booking date. This transfer may only be made once per booking, per six months.

After a transfer has been used, or if the Renter fails to provide sufficient notice, the booking and payment are forfeited in full.

No credits, extensions, or additional transfers will be offered beyond this one-time date change allowance.

CONDITIONS AND RESPONSIBILITY

The Renter will assume full responsibility for any and all losses, damages, or liabilities to the premises or its contents that may occur for the duration of their rental time. Any damages or cleaning fees will be billed to the Renter and are due immediately.

The Renter agrees to leave The Space clean, organized, and ready for the next booking, and to ensure the front door is locked upon leaving.

No personal materials (music, mats, props, written material, etc.) may be left on the premises unless previous written agreement has been received. Any items left without permission may be removed/disposed of at the Owner’s discretion. The Owner does not provide insurance or protection for any items left on the premises. Renter acknowledges that other people may be coming and going at the space, and the Owner is not responsible for any loss, damage, or theft of items left at the premises.

– The Renter is responsible for ensuring that all lights, fans, and all heat/AC units are turned off before leaving.
No candles or open flames may be used at any time.
No smoking or vaping inside The Space.
– The Renter shall not decorate, remodel, paint, or alter anything in The Space.
No alcohol or drugs are permitted at any time.

Renter may not attach, affix, or install any signage, banners, decorations, or fixtures to walls, doors, or other surfaces without the Owner’s prior written approval. All approved decorations must be removed at the end of the rental period.

The Renter assumes full responsibility and liability for all persons who enter The Space during the rental period, including but not limited to guests, attendees, staff, and service providers. The Renter agrees to be fully responsible for any and all damages, losses, injuries, legal violations, or other liabilities occurring during their use of the premises

VENUE USAGE

The Renter is responsible for all setup and cleanup, including returning The Space to ready to use condition. This includes:

– Sweeping, vacuuming or mopping floors if needed
– Taking out garbages and replacing an empty bag (upstairs and bathroom)
– Returning all furniture and equipment to original locations
– Turning off all lights, fans, and AC units
– Locking the premises securely

Failure to leave The Space clean and ready may result in a minimum $100 cleaning fee, charged at the Owner’s discretion.

Access: Renter will be given the lock box code to enter the building. This code is for the signed contract holder only.

STAFF POLICY: Email notice and approval are required to share the lock box code with staff. If the code is shared without approval, the contract may be cancelled.

Renter may only access The Space during the scheduled rental period unless prior written approval is obtained from the Owner. Early entry or setup without approval may result in additional fees or cancellation. Yoga mats, fans, chairs, tables, and any other items stored at The Space may NOT be removed from the venue at any time.

In the winter, Renter is responsible for snow removal of the walkway during rental times.

Renter and their guests must adhere to all posted parking regulations and any instructions provided by the Owner regarding access to The Space, including loading and unloading procedures. PLEASE DO NOT BLOCK GARAGE DOOR.

The Owner is not responsible for any loss, damage, or theft of vehicles, or for any fines, towing, or other penalties incurred by the Renter or their guests. Renter agrees to ensure that all attendees comply with these rules.

The Owner reserves the right to restrict or modify access to parking or entry areas at any time to maintain safety, security, or compliance with municipal regulations.

INSURANCE

The Renter understands and agrees that they are fully responsible for obtaining liability insurance coverage for their event or rental use. Renter will name “Alexis Wild, operating as The Space / More Joy Better Life” as an Additional Insured on that policy for the duration of their rental period. Proof of coverage must be provided prior to the rental date upon request.

If the Renter does not carry their own insurance, they accept full personal responsibility for any injuries, damages, losses, or legal claims that may arise during or as a result of their use of The Space.

By entering into this Agreement, the Renter acknowledges that Alexis Wild, The Space, and More Joy Better Life carry no responsibility for injuries, losses, theft, or damages that occur during their use, and the Renter accepts full legal and financial responsibility for any such occurrences.

FORCE MAJEURE/ UNFORESEEN EVENTS

The Owner shall not be liable for any failure or delay in providing access to The Space, or for any interruption, cancellation, or rescheduling of a rental due to causes beyond the Owner’s reasonable control, including but not limited to: fire, flood, severe weather, power outages, government action, labor disputes, acts of God, pandemic or health-related restrictions, or any other unforeseen events.

In the event of such occurrences, the Owner may, at their discretion:
– Reschedule the rental to a mutually agreeable date; or
– Cancel the rental.

Owner may offer rescheduling at their discretion; Renter agrees no additional compensation will be sought. Rental payments are non-refundable under these circumstances. The Renter waives any claim for damages, loss of profit, or compensation arising from such events.

LIABILITY & INDEMNIFICATION

The Renter assumes full responsibility and liability for all persons who enter The Space during the rental period, including but not limited to guests, attendees, staff, and service providers.

The Renter agrees to indemnify, defend, and hold harmless Alexis Wild, More Joy Better Life, The Space, and any of their representatives or affiliates, from and against any and all claims, damages, liabilities, injuries (including death), losses, costs, or expenses (including legal fees and court costs) arising from or related to:
– The Renter’s use of the premises
– Any accidents, injuries, theft or property damage occurring during the rental
– Any breach of this Agreement
– Any act or omission by the Renter or their guests

This indemnification shall survive the termination or expiration of this Agreement.

ILLEGAL OR PROHIBITED ACTIVITIES

No illegal, unsafe, or prohibited activities may take place in The Space. This includes, but is not limited to, the use or possession of drugs or alcohol, unlawful gatherings, excessive noise, or any activity that violates local laws, bylaws, or regulations.

COMPLIANCE WITH LAWS

Renter agrees to comply with all applicable federal, provincial, and municipal laws, regulations, bylaws, and licensing requirements related to their activities at The Space. This includes, but is not limited to:

– Fire safety regulations
– Occupancy limits
– Health and safety standards
– Licensing requirements for any commercial activities

The Renter acknowledges that failure to comply with laws may result in termination of the rental, fines, or legal action, for which the Renter shall be fully responsible.

Owner’s Right to Cancel: The Owner reserves the right to cancel or terminate any rental at any time, for any reason, with or without notice. Reasons for cancellation may include, but are not limited to:

– Safety or security concerns
– Violation of any rules, policies, or terms in this Agreement
– Scheduling conflicts or operational needs
– Conduct, behavior, or demeanor of the Renter or their guests
– Any other reason the Owner deems necessary, including personal discretion

The Owner shall not be liable for any damages, losses, expenses, or inconvenience incurred by the Renter as a result of such cancellation or termination. The Renter acknowledges and agrees that the Owner’s exercise of this right is absolute and at their sole discretion, and that no action or claim against the Owner shall arise from such cancellation or termination.

SEVERABILITY

If any provision of this Agreement is found by a court or other authority to be invalid, illegal, or unenforceable, that provision shall be considered modified to the minimum extent necessary to make it valid and enforceable, or if not modifiable, it shall be severed entirely from this Agreement.

All remaining provisions of this Agreement shall remain in full force and effect, and the unenforceability of any provision shall not affect the validity or enforceability of any other provision.

DISPUTES

Any disputes arising under this Agreement shall first be attempted to be resolved through mediation. If mediation fails, the dispute will be resolved in accordance with the laws of the Province of Ontario, and venue shall be in the City of London, Ontario.
