RENTAL AGREEMENT

This Rental Agreement (“Agreement”) is entered into between the Owner and the undersigned Renter.

By completing and submitting this Agreement electronically, the Renter acknowledges that this document is legally binding and enforceable.

1. BOOKING & PAYMENT

All bookings must be paid in full to be confirmed.
No dates are secured until:

1. This Agreement is completed, and
2. Full payment has been received. Payment must be made by e-transfer to: bookthespacelondon@gmail.com (This email is for payment only.) Rental Rate: $38/hour + HST

Discounted daytime and bundle rates may apply where agreed in writing.

Monthly Rentals
– First and last month’s rent are required to secure ongoing dates.
– Monthly renters may pay biweekly or monthly.
– A minimum of 30 days written notice is required to cancel or modify ongoing bookings.
– Failure to pay on time voids any applicable discount for that month.

2. SECURITY DEPOSIT

A refundable $300 security deposit may be required at the Owner’s discretion.

The deposit will be returned within 2 business days provided:
– No damage has occurred
– No cleaning fees apply
– No overtime charges apply
– The Space is returned in original condition

The Owner retains sole discretion in assessing damages or additional charges. If damages are made and exceed $300, they will be immediately billed to the Renter, to be paid within seven days of receipt.

3. CANCELLATION & TRANSFERS

All rental payments are strictly non-refundable.

The Renter may transfer a booking one (1) time only if:
– At least 7 days written notice is provided.
– The new date occurs within 60 days of the original booking.
– The transfer is used no more than once within a six-month period.

No credits, refunds, or additional transfers will be granted. Rental payments remain non-refundable under force majeure or unforeseen circumstances (see Section 10).

4. RENTAL TIME & OVERTIME

Rental time includes a 15-minute set up/clean up buffer before and after the scheduled booking. This is NOT extra time for classes, etc. You MUST be completely out of the venue, doors locks BEFORE the time buffer is up. You may NOT access the venue until your time.

The Renter must:
– Arrive and vacate within the booked time ONLY.
– Not enter early or remain late without written approval.

Overtime will be billed at $60/hour in 15-minute increments at the Owner’s discretion.

5. USE OF SPACE

The Renter will assume full responsibility for any and all losses, damages, or liabilities to the premises or its contents that may occur for the duration of their rental time. Any damages or cleaning fees will be billed to the Renter and are due immediately.

The Renter is responsible for:
– All setup and cleanup.
– Returning furniture and equipment to original positions.
– Sweeping/mopping floors if needed.
– Removing garbage AND replacing liners
– Turning off all lights, fans, and HVAC units
– Locking the premises securely
– Adhering to parking guidelines

Failure to leave The Space clean and ready may result in a minimum $100 cleaning fee.

No candles, open flames, smoking, vaping, alcohol, or drugs are permitted. No removal of any furniture, equipment, etc from The Space at any time.

No decorating, alterations, signage, or fixtures may be installed without prior written approval.

No items may be left onsite without written permission. Items left without permission may be removed or disposed of.

In winter months, the Renter is responsible for snow removal and salting of the walkway during rental times.

6. ACCESS, LOCKBOX & SUBLETTING POLICY

Renter will receive a lockbox code for access. Code is for the contract holder ONLY. Written approval is required before sharing with staff. Unauthorized sharing may result in immediate cancellation.

Renter may only access the Space during scheduled rental time unless approved in writing.

The Owner reserves the right to restrict access for safety or operational reasons.

No subletting, assignment, or transfer of this rental to any third party is permitted without the Owner’s prior written consent. Any attempt to sublet will result in immediate cancellation of the booking, forfeiture of payment, and potential additional charges.

7. LIABILITY & RESPONSIBILITY

The Renter assumes full responsibility and liability for:
– All persons entering the premises during the rental period,
– Any damages, injuries, losses, theft, or legal violations occurring during use,
– Compliance with all federal, provincial, and municipal laws
– Fire safety, occupancy limits, licensing requirements

The Owner is not responsible for:
– Injury or death
– Theft or loss of property
– Vehicle damage or towing
– Fines or penalties incurred by the Renter or guests

The Renter agrees to indemnify, defend, and hold harmless Alexis Wild, More Joy Better Life, and The Space from any and all claims, damages, legal fees, or liabilities arising from use of the premises.

This clause survives termination of this Agreement.

8. INSURANCE

The Renter is responsible for obtaining liability insurance for their event. Upon request, the Renter must provide proof of insurance and name: “Alexis Wild operating as The Space / More Joy Better Life” as Additional Insured. If the Renter chooses not to obtain insurance, they accept full personal legal and financial responsibility for all risks.

9. ILLEGAL OR PROHIBITED ACTIVITY

No illegal, unsafe, or prohibited activities are permitted. Violation of laws or this Agreement may result in immediate termination without refund.

10. FORCE MAJEURE

The Owner is not liable for delays, interruptions, cancellations, or inability to provide access due to circumstances beyond reasonable control including but not limited to: Fire, Flood, Severe weather, Power outage, Government action, Pandemic restrictions, Acts of God, or any other unforeseen events.

In such cases, the Owner may: Reschedule the booking, or Cancel without refund.

The Renter waives any claim for damages or compensation.

11. OWNER’S RIGHT TO CANCEL

The Owner reserves the absolute right to cancel or terminate any rental at any time, with or without notice, for any reason including but not limited to:
– Safety concerns
– Policy violations
– Operational needs
– Behavior or conduct concerns
– Personal discretion

The Owner shall not be liable for damages, expenses, or inconvenience resulting from cancellation.

12. DISPUTES & GOVERNING LAW

This Agreement shall be governed by the laws of the Province of Ontario. Any disputes shall first attempt mediation. If unresolved, venue shall be London, Ontario.

13. SEVERABILITY

If any provision is found unenforceable, all remaining provisions remain in full force.

SIGNATURE CONFIRMATION

The undersigned hereby assumes all risk of injury or harm as a result of the activities specified above and agrees to release, indemnify, defend, and forever discharge Alexis Wild, operating More Joy Better Life and The Space from all liability, claims, demands, damages, costs, expenses, and causes of action due to death, injury, loss, or damage to the undersigned.

Renter agrees that typing their full name and submitting this agreement online constitutes a legally binding signature and indicates full acceptance of all terms and conditions outlined in this Agreement. By completing the electronic agreement, Renter acknowledges that they have:

– Read and understood all clauses of this rental agreement
– Agreed to assume all responsibilities, risks, and liabilities outlined herein
– Accepted that no physical signature is required for this Agreement to be enforceable
